In addition to the $355 million penalty — payback of what the judge deemed “ill-gotten gains” from his spurious financial statements — Trump is required to pay interest on that amount. James’ office calculates that, to date, Trump owes an additional $98.6 million in interest, bringing his total penalty to $453.5 million. Trump used $170 million of the $375 million to pay off a loan on the property. — $60 million, plus interest, from selling the rights to manage a New York City golf course in June 2023. Trump testified that regardless of what his financial statements said, banks did their own due diligence and would’ve qualified him for the loans anyway.

CNN —Judge Arthur Engoron hit Donald Trump with his biggest punishment to date on Friday, in a ruling that fined the former president $355 million for fraudulently inflating the values of his properties. Combined with the $83 million judgment issued against Trump for defaming E. Jean Carroll, that means Trump has been fined roughly $438 million over the past four weeks. Engoron found that the defendants’ fraud saved them about $168 million in interest, fining Trump and his companies that amount. “Overall, Donald Trump rarely responded to the questions asked, and he frequently interjected long, irrelevant speeches on issues far beyond the scope of the trial,” Engoron wrote. properties that offered a much lower valuation than reported on Donald Trump’s financial statements.

CNN —A New York state judge has the future of Donald Trump’s business empire in his hands. The civil lawsuit from New York Attorney General Letitia James, a Democrat, is seeking $370 million from Trump and the other defendants (the figure was originally $250 million). The back and forth between the judge, Trump and the former president’s lawyers during the trial was repeatedly heated. “What evidence do you have – I just haven’t seen it – that they knew that there was fraud?” Engoron asked. New York CNN —A New York appellate court has reinstated a gag order prohibiting former President Donald Trump and attorneys from making public statements about the courtroom staff in the ongoing $250 million civil fraud trial. The appeals court paused the gag order earlier this month, but on Thursday said it should be restored while the official appeal is pending. During a break in the trial Thursday morning, Engoron announced the appeals court ruling reinstating the gag order. However the ex-president’s appeal ends against a limited gag order imposed in his federal election subversion case, he can expect a benefit. A judgment in Trump’s favor on the gag order – which has been temporarily frozen while the appeal is heard – would pale against his four criminal trials and his current civil fraud trial in New York. How the gag order case reflects Trump’s intense challenge to accountabilityThe gag order appeal is entwined with complex arguments on the breadth of the First Amendment and the extent to which courts have the right to regulate its scope in order to protect their officers and proceedings and the administration of justice. Trump’s legal team argued that any restrictions on his comments represent an unconstitutional assault on his rights to freedom of political speech. The incitement issue is not a hypothetical one in the gag order case.

Judge Rejects Trump’s Motion for Mistrial

The New York judge overseeing Donald Trump’s $250 million civil fraud case rejected a motion for a mistrial from the former president and his co-defendants on Friday, calling the arguments provided by their defense team to throw out the case “utterly without merit.”“In good conscience, I cannot sign a proposed order to show cause that is utterly without merit, and upon which subsequent briefing would therefore be futile,” Judge Arthur Engoron wrote. Earlier this week, Trump, his adult sons Donald Trump Jr. and Eric Trump, the Trump Organization and its top executives argued that the case had been undermined by political bias – specifically, that Engoron and his law clerk had “tainted the proceedings” and that the evidence was “tangible and overwhelming.”Their 30-page motion for dismissal points to news stories from NPR, The New York Times and others that Engoron shared in his high school alumni newsletter, which they claimed are disparaging of Trump, and to political contributions to Democratic groups made by his law clerk, which they called “partisan activities.”They also included photos of Engoron and his clerk seated next to each other and accused them of “co-judging” the case. “Such arguments are nonsensical,” Engoron wrote. Editorial Cartoons on Donald Trump View All 692 ImagesEngoron imposed a partial gag order on Trump last month after the former president posted a photo of the judge’s law clerk – who also sits next to the judge – alongside Senate Majority Leader Chuck Schumer and referred to her as “Schumer’s girlfriend.” The order barred Trump, his defense team and the prosecution team from making public statements about his staff. As it stands, Engoron has fined Trump twice – $5,000 and later $10,000 – for breaking the gag order.

In preparing financial statements, also known as compilations, accountants need only documentation used to determine the value of assets, like Trump’s skyscrapers, golf courses and other properties. The firm cut ties with Trump last year and said his financial statements “should no longer be relied upon” after James raised concerns about their accuracy. James, a Democrat, alleges Trump, his company and top executives exaggerated his wealth by billions of dollars on the financial statements by inflating property values. On the stand Tuesday, Flemmons echoed Trump’s longstanding assertion that disclaimers on the financial statements insulated him from liability for discrepancies or misstatements. Trump has argued that, if anything, his financial statements undervalued how much his properties were worth.

Judge Arthur Engoron sided with Donald Trump’s attorneys, overruling an objection from the New York attorney general’s office to admit a PowerPoint presentation showcasing the history of the Trump Organization. The presentation, titled “The Trump story,” also included photos of Donald Trump with his father, Fred Trump, as well as sleek photos of various Trump buildings. The PowerPoint included Trump's purchase of Mar-a-Lago in 1985, which Trump Jr. described as "one of the few sort of American castles." Assistant Attorney General Kevin Wallace objected to the presentation, claiming the text descriptions were coaching the witness. The judge has also sided with Trump's lawyers during the trial, but this signals the judge is going to give a lot of leeway to both sides in their presentation.

But the trial quickly became a test of wills between Trump and Engoron over who controlled the court. But by the end of the day, Engoron’s resolve frayed: “It feels like a broken record,” he said of Trump’s answers. Just 30 minutes after Trump was sworn in, Judge Arthur Engoron – frustrated by the former president’s non-answers – turned to the former president’s defense team for help. Trump is known for being long-winded and talking around an issue instead of answering questions directly. “This is not a political rally.”But Trump’s two lead attorneys, Chris Kise and Alina Habba, did little to help. “This is a very unfair trial,” Trump said from the witness stand. The high-stakes civil case strikes at the heart of Trump’s brand – his real estate empire. New York Attorney General Letitia James is suing Trump for $250 million and seeking to bar him from doing business in the state. Trump’s rhetoric prompts an angry response from the judgeEngoron tried at the outset of Trump’s testimony to stop the former president from making speeches and instead answer the questions, but it did little to change Trump’s approach. “There’s a disclaimer clause where you don’t have to get sued by the attorney general of New York,” Trump said.

CNN —The judge overseeing Donald Trump’s civil fraud trial has expanded a gag order in the trial to extend to Trump’s attorneys after continued lengthy discussions about the judge’s communications with his law clerk during court this week. In a written order Friday, Judge Arthur Engoron prohibited Trump’s attorneys from making any further comments about confidential communications between the judge and his staff inside or outside of the courtroom. The second fine – $10,000 – came after Trump appeared to reference the clerk when speaking to reporters outside of the courtroom. Engoron said he has a right to seek counsel from his clerk and Trump’s legal team has no right to know what they are. “She’s a civil servant, she’s doing what I ask her to do.” Those notes are “confidential communications from my law clerk,” Engoron said Thursday, pounding on the bench.

New York (CNN) — Ivanka Trump must testify at her father’s New York civil fraud trial, the judge overseeing the case ruled on Friday. Ivanka Trump’s attorney had argued that she should not be forced to appear after an appellate court removed her as a defendant in the case. The judge also said Ivanka Trump should have submitted an affidavit asserting that she does not live or work in the state presently. Ivanka Trump was still identified by the New York attorney general’s office as a potential witness they could call in the case. Another Trump attorney, Cliff Robert, said Eric Trump is willing to be the corporate representative for the Trump Organization because he’s going to be testifying at trial anyway.

Engoron had put a gag order in place the first week of the trial after Trump had posted on social media attacking his clerk. In his written order Thursday, Engoron said the explanation Trump gave that he was talking about Cohen did not pass muster. NEW YORK (AP) — Donald Trump isn’t used to constraints. Trump is not only a former president, but also the leading candidate for the 2024 Republican presidential nomination. Just days ago, he was fined $5,000 for violating the same gag order, which Engoron imposed after Trump targeted his principal law clerk on social media. Indeed, things are likely to get much more complicated for Trump in the coming months as his four criminal trials get underway. New York court officials have beefed up security for judges and court personnel involved in Trump matters in the wake of the threats.

New York CNN —An apparent backtrack by Donald Trump’s ex-lawyer and fixer Michael Cohen threw the New York civil fraud trial into more chaos Wednesday afternoon. But after lunch, Cliff Robert, another Trump attorney, pressed Cohen further on his congressional testimony, and Cohen had a different response, saying that the testimony was not false. “The witness just admitted that we won the trial,” Trump told reporters in the hallway. “And the judge should end this trial immediately.”The New York attorney general’s lawyers asked Cohen in follow up questions to clarify his response. A judge presiding over the $250 million fraud trial against Donald Trump took the unusual step of ordering the former president to the stand, where he was grilled over remarks minutes earlier that broke a gag order, fined $10,000 and warned that next time the penalty will be worse. Trump said his remarks were referencing Michael Cohen, his former lawyer and business associate, who was testifying on the witness stand on Wednesday. But, in light of previous events that led to the gag order, the judge brusquely rejected Trump’s testimony. With Trump sitting feet away, Trump’s one-time lawyer and fixer described how he manipulated Trump’s financial statements – “reverse-engineering” them to hit an arbitrary net worth. We’re not worried at all about his testimony,” Trump said during a lunch break. The tense questioning is going to continue into Wednesday, as Habba hadn’t even started on the substance of Cohen’s testimony in the civil fraud trial. In the July 2014 letter submitting a bid to buy the Bills, Trump claimed his net worth was $8 billion. Before Engoron’s ruling, the state attorneys and Trump’s lawyers clashed over Michael Cohen’s testimony about the letter.

Shannon Stapleton/Pool/Getty ImagesJudge Arthur Engoron, who is overseeing the New York attorney general’s civil case against Donald Trump, said Tuesday that the trial itself is not the venue for Trump’s attorneys to contest what he’s already ruled on. Leaving court Monday, Trump incorrectly claimed that the judge had agreed that 80% of the attorney general’s case was thrown out because of the statute of limitations. It’s one of several allegations contained in the attorney general’s civil case against Trump, but it could lead to stiff penalties for his business.
